Supreme Court delays women entry to Haji Ali, hearing on October 17

The CJI told the counsel problem arises only if you allow men and don't allow women. You take a progressive stand on the issue.

New Delhi: The Supreme Court on Friday while staying the Bombay High Court order directing Haji Ali Dargah trust to allow entry of women into the inner sanctum sanctorum, asked it to come out with a progressive stand on this issue before the next hearing on October 17.

A bench Chief Justices T.S. Thakur and Justice A.M. Khanwilkar while issuing notice to the PIL petitioner, on whose petition the ban was lifted, agreed to hear in detail on October 17, the appeal filed by Haji Ali Dargah trust challenging the Bombay High Court order. When senior counsel Gopal Subramanium appearing for the trust said the HC itself had suspended its order till Friday, the Bench extended the stay till October 17.

Mr. Subramanium submitted to the court that there is a problem if women are allowed to go beyond a point into the sanctum sanctorum though men are allowed to go inside. The CJI told the counsel “problem arises only if you allow men and don’t allow women. You take a progressive stand on the issue.”
