Expelled MLAs to Hyderabad HC: Didn't get chance to explain

They urged the court to declare their expulsion as illegal and set aside the action of the Speaker in notifying the vacancy of segments.

Hyderabad: Expelled Congress MLAs have informed the Hyderabad High Court that they were expelled from the Assembly without being given an opportunity to give them an explanation.

Mr Komatireddy Venkat Reddy and Mr A. Sampath Kumar, in their reply affidavit to the contention of the state government’s law and legislator department, stated that it has not authorised to narrate any happenings inside the Assembly, and told the court that their main contention in the petition was that they had been expelled from the House for the alleged harm to the Chairman of the Legislative Council.

They added that they were neither given an opportunity to explain themselves, nor we-re they informed about the reasons for their expulsion, and whatever information they had received regarding the same was through media reports.

The MLAs said that the legislative body functions as per conventions, procedures and practices and none of those were followed while expelling them. While citing the various judgments of the Supreme Co-urt and various High Courts, they contended that that Article 122 and 212 of the Constitution of India will not bar the jurisdiction of the Courts when malafides, bias and violation of principles of natural justice, irrationality and fair play are violated.

They said that in the Alagapuram R. Mohanraj case, the court held that even the proceedings inside the House can be interfered with if Article 14 is violated, particularly when the principles of natural justice is violated.

They urged the court to declare their expulsion as illegal and set aside the action of the Speaker in notifying the vacancy of Alampur and Nalgonda Assembly segments.
