Central Administrative Tribunal order to post visually impaired
Hyderabad: The Hyderabad bench of the Central Administrative Tribunal came to rescue of a visually impaired candidate by directing the Centre to appoint him to civil service and allocate a suitable post based on the rank he secured in Civil Service Examinations 2016. A two-member bench comprising Justices R. Kantha Rao and Minnie Mathew allowed an application by Rizwan Basha Shaik from Kurnool, challenging the proceedings issued by the Department of Personal and Training (DoPT, IAS division) cancelling his selection.
The petitioner said he had appeared for civil service examination 2016 under visually impaired quota and was given relaxation considering the certificate produced by him which indicated that he was 40 per cent disabled. He submitted that he had secured 48th rank and was referred to the medical board which certified that he had 30 per cent disability. When he preferred appeal against the decision before the appellate board, it certified that he had 40 per cent disability.
Subsequently, he received communication from the authorities that his selection was cancelled based on the decision of the expert committee as it was certified he had 30 per cent disability. It also said the expert committee gave its decision without physically examining him. The bench pointed out that DoPT, which had agreed with the certification of appellate medical board, subsequently referred the case of the petitioner to the expert committee without notice to him and there was no physical examination. Setting aside the cancellation proceedings, it directed the respondent authorities to appoint the petitioner in three months.
