Hoarding ban to stay: Karnataka High Court reverses order
Bengaluru: Within 24 hours of the the Karnataka High Court quashing the BBMP's resolution banning advertisement hoardings for a year in the city, a division bench headed by the acting Chief Justice stayed the single judge order on Thursday.
The BBMP had swiftly filed an appeal challenging Wednesday's order, arguing that when the main petition filed against the ban on hoardings by the advertising agencies was still pending disposal, quashing the resolution would amount to allowing it. "Quashing the resolution impugned in the writ petition amounts to disposal of the main matter," its senior advocate argued.
Agreeing with him, the division bench headed by the acting Chief Justice observed that "Admittedly, prayers made in the writ petition (filed by the advertisement agencies) are for quashing the resolution dated 06.08.2018. Therefore, we are of the view that the impugned order amounts to disposal of the main matter itself. An interim order should always be ancillary to the main relief, " before it stayed the order of the single judge in the matter.
