Hyderabad High Court sets aside order on land acquisition

The petitioners told the court that the authorities have not conducted the Gram Sabha under section 11(2) of Land Acquisition Act 2013.

Hyderabad: The Hyderabad High Court has set aside the final declaration issued by the Land Acquisition Officer for acquiring lands in Mamidyal village of Siddipet district for construction of Kondapochamma Sagar as part of Kaleswaram Lift Irrigation Project.

Justice A. Rajasheker Reddy was partly allowing two petitions by Praveen Kumar and other 30 farmers of the village challenging the action of the authorities in acquiring the la-nds in violation to the law and without the executive sanction for preliminary notification.

The petitioners told the court that the authorities have not conducted the Gram Sabha under section 11(2) of Land Acquisition Act 2013 and without considering their objections the Land Acquisition Officer has issued the final declaration.

The judge directed the officers to conduct Gram Sabha as per section 11(2) of the Act and then hear the objections as per Section 15(2) and then only consider the further steps for passing award , payments of compensation and taking possession of lands.
