New Delhi: A five-judge Constitution Bench of the Supreme Court on Tuesday refused to review the December 2015 verdict in the ‘Rajiv killers remission case’ holding that only the Central government and not the State government will have the power to grant remission in CBI investigated cases.
A Bench of Chief Justice J.S. Khehar and Justices Pinaki Chandra Ghose, S.A. Bobde, A.M. Sapre and Uday Lalit dismissed as no merits the review petition filed by one of the convicts, Perarivalan, against the verdict. Perarivalan supported Tamil Nadu government’s stand that it had the power to grant remission to life convicts.
He said the power to grant remission was in the executive domain. He also argued that “practically the appropriate government can remit, commute or even pardon the sentence of a prisoner.
