Hyderabad High Court vacates order on Daspalla Hills land
Hyderabad: The Hyderabad High Court on Wednesday set aside an order passed by a single judge directing the concerned sub-registrar in Visakhapatnam city to register land in the Daspalla Hills in the name of M/s. SSNR Projects Pvt. Ltd. A division bench comprising Acting Chief Justice Ramesh Ranganathan and Justice G. Shyam Prasad, while dealing with an appeal filed by the Andhra Pradesh government challenging the order of the single judge, pointed out that it would not be proper on the part of the petitioner company to get an order based on an interim order passed in an earlier case without challenging the order issued by the District Collector prohibiting the registration of the subject land under Section 22 (A) of the Registration Act.
A single judge in 2016 granted an interim order directing the sub-registrar to register 636 sq. yards in favour of the petitioner company. Aggrieved by the order, the Andhra Pradesh government filed a vacate petition before the judge, and when the judge refused to vacate the interim order, the government moved an appeal before the division bench.
While setting aside the order passed by the single judge, the bench considered the request of the petitioner company to grant liberty to challenge the order issued by the Collector prohibiting the registration of the subject land.
