Product seizure: Cigarette firm's plea turned down by Karnataka HC

The court was hearing the interlocutory application (IA) filed by the cigarette manufacturing company.

Bengaluru: The High Court on Monday refused to rectify and delink the petition of a cigarette manufacturing company, whose goods worth Rs 103 crore were seized for not complying with the Cigarettes and Other Tobacco Products (Packaging and Labelling) Amendment Rules, 2014 which makes it compulsory to have 85 percent pictorial warning on tobacco products.

The court was hearing the interlocutory application (IA) filed by the cigarette manufacturing company. The company had approached the court saying that the rules were imposed from April this year and they had manufactured goods worth more than Rs 103 crores in the month on March which were seized. They stated that a stay was granted by the Bombay HC and the SC, on further seizure.

The SC had passed an order to hear all the petitions filed before various courts in the country with regard to 85 percent pictorial warning on tobacco products in the HC The SC had directed the company to approach Karnataka High Court for relief and the company in their IA had contended that they have not challenged the constitutional validity of the Rules and only sought directions to recover the seized goods and sell them. The court has refused to delink the matter.

HAL test flights get court’s nod
The High Court on Monday disposed of a PIL questioning the experimental test flights being carried out by HAL in densely populated residential areas.
“HAL airport is located very close to the CBD and it would be inappropriate to fly aircraft in residential areas," the petitioner stated while seeking directions to HAL to conduct these experiments in an alternate aerodrome.

The court disposed the petition after the advocate representing HAL submitted that they are complying with the provisions of Section 9A of the Aircraft Act, 1934 which speaks about the power of the Central government to prohibit or regulate construction of buildings, planting of trees and so on.
