Proceedings against 2 Tamil Nadu MLAs stayed by top court

Further the no confidence motion was brought against the Speaker after the show cause was issued to the MLAs.

New Delhi: In a relief to two of the three dissenting AIADMK MLAs, the Supreme Court on Monday stayed all proceedings pending before the Tamil Nadu Speaker relating to show cause notice issued to them as to why they should not be disqualified from the House for their alleged anti-party activities.

A bench of Chief Justice Ranjan Gogoi and Justice Deepak Gupta passed this order after hearing senior counsel Kapil Sibal for the two MLAs and senior counsel Mukul Rohatgi on behalf of the Speaker. Mr Sibal maintained that the petitioners apprehended that they would be disqualified by the Speaker even though notice of no confidence motion was pending against him. Mr Rohatgi however argued that the petition was not maintainable as the Speaker was yet to pass any order. Further the no confidence motion was brought against the Speaker after the show cause was issued to the MLAs.
