No construction on disputed site: Nadigar Sangam

The advocate commissioner was at liberty to seek all the records from the revenue department and even from chennai Corporation.

Chennai: The Nadigar Sangam Charitable Trust on Saturday informed Madras high court that no construction would be carried out on the disputed site in T. Nagar till the matter is decided by the court.

Senior Counsel A.L. Somayaji, appearing for Nadigar Sangam, made this submission when the petition filed by K.M. Srirangan and R. Annamalai, residents of Vidhoyadaya colony, came up for hearing before a division bench comprising Justices N. Kirubakaran and V. Parthiban.

Petitioners sought to restrain the authorities from permitting Nadigar Sangam Charitable Trust and South India Artistes Association to encroach the 33 feet public road leading from Habibullah road to Vidhyodaya first cross road, which was classified as a road in the revenue records or putting up any illegal construction on it.

After going through the records and the map produced by CMDA and Chennai corporation, the bench appointed advocate K.Ellangoo as the advocate commissioner to measure the property of Nadigar Sangam with the assistance of assistant director of Survey and Land Records and tahsildar, Guindy taluk, accommodated by head surveyor, Guindy taluk.

The advocate commissioner was at liberty to seek all the records from the revenue department and even from chennai Corporation. The advocate commissioner will visit the property, measure the property and also physical features, the bench added and directed the advocate commissioner to file his report before the court on May 29.
