Lawyers back judgment on encounters

Bench said that it was a historic judgment and it stays important till date because no other judgment in such cases is as comprehensive.

Hyderabad: Indian Association of Peoples Lawyers (IAPL) on Wednesday demanded implementation of the erstwhile Andhra Pradesh High Court’s sensational judgment by the five-member bench on encounter killings.

M. Venkanna, D. Suresh Kumar and Balla Ravindranath advocates and office-bearers of the IAPL, speaking at a press conference here ruled that 10 years ago on this day, a larger bench of the erstwhile Andhra Pradesh High Court said that the every police encounter killing has to be registered as an FIR against the policemen involved under the Section 302 of IPC (murder) and an investigation must follow immediately.

They said that it was a historic judgment and it stays important till date because no other judgment in such cases is as comprehensive.

They said that in the judicial history of this country the larger bench has answered several legal questions involving in police encounters by summarising all crucial issues involved in the encounter killings.

They pointed out that the larger bench delivered the order on February 6, 2009 and after that till the end of April 2009 there was no single encounter killing untill AP Police Officers Association approached the Supreme Court and obtained stay on the judgment after which the encounters resumed. They said even after 10 years this matter is pending as the stay order is yet to get a final hearing in the Supreme Court.
