Time not ripe for floor test, says AG

The bench posted to October 3 the question of maintainability of the PIL.

Chennai: The Advocate General who appeared on behalf of the Tamil Nadu Governor informed the Madras high court that the situation had not arrived for the Governor's interference in the affairs of government and to seek a floor test in Assembly.

When a PIL filed by advocate Pugzalenthi seeking a direction to the Governor to conduct a floor test in the Assembly before the first bench comprising Chief Justice Indira Banerjee and Justice M. Sunder, Advocate General Vijay Narayan submitted that the recent developments in the AIADMK were an intra-party affair and the Governor cannot interfere in this. The situation to prove majority had not arrived.

Pugzalenthi's counsel M Radhakrishnan pointed to the development in the AIADMK party that out of its 122 MLAs, 19 had withdrawn support to the present Government under Chief Minister Edappadi K. Palaniswami and hence the Governor is bound to call for a floor test in the Assembly.

The Governor also received a letter from leader of the opposition and DMK working president MK Stalin requesting the upholding of constitutional norms by directing the present CM to prove his majority. Radhakrishnan said that inaction on the part of the Governor would pave the way for horse-trading and would affect the people at large.

The Advocate General submitted that the alleged letter given by 19 MLAs was not against government and it was only against a person who is the present Chief Minister. The bench posted to October 3 the question of maintainability of the PIL.
