Madras high court: Finish inquiry against area director of spl olympics

The bench said Paul Devasagayam may file a copy of their registration and constitution and bylaws of the trust.

Chennai: Directing B.Maheswari, IAS, state commissioner for persons with disabilities, to complete the inquiry into the allegations raised against J.Paul Devasagayam, area director, Special Olympics Bharat-Tamil Nadu, with respect to the selection process of players made during the last year 2018 and pass appropriate orders on the same, the Madras high court has requested W.I.Devaram, IPS, former DGP, to supervise the inquiry proceedings.

A division bench comprising Justices Vineet Kothari and C.V.Karthikeyan gave the directive on a petition filed by C.K.Mano Ranjani, which sought a direction to the Union government and Special Olympics Bharat to frame binding rules, regulations and guidelines for Special Olympics Bharat-Tamil Nadu, in respect of the manner in which the selection process and training of the intellectual disabled for each category of sports and their participation in the sport events and make it available in the officials web-site and newspapers.

The bench said Paul Devasagayam may file a copy of their registration and constitution and bylaws of the trust, under which he was working as area director for the last many years, the funding of the said trust, the sources thereof, and the manner of spending the same, a brief note about the selection process for the players in the last few years and he may particularly state as to whether besides the recommendation of the district secretaries, the selection process was open to all differently abled persons or not. Such report with affidavit may be filed within 2 weeks, the bench added.

The bench said B.Maheswari, IAS, state commissioner for persons with disabilities, was directed to complete the inquiry into the allegations raised against Paul Devasagayam with respect to the selection process of players made during the last year 2018, to which the necessary pleadings in the form of complaint and counter of Paul Devasagayam were on record of the commissioner. The commissioner may hold such enquiry, after recording the statements of relevant persons and pass appropriate orders on the same and the said commissioner was free to take action as per the powers conferred upon the commissioner under section 80 of the Rights of the Persons with Disabilities Act under the supervision of W.I.Dewaran, IPS, former DGP . "We request W.I.Dewaram, IPS, former DGP, Tamil Nadu, who is the president of Tamil Nadu Athletic Association, and who has, in his communication dated July 24, 2018, addressed to Air Marshal Denzil Keelor, CEO of Special Olympics Bharat, regarding Paul Devasagayam, Area director, Specia

l Olympics Bharat-Tamil Nadu to supervise the aforesaid enquiry proceedings undertaken by the state commissioner and submit his independent report to the court, about nature of enquiry held by the state commissioner. He may also submit the report about the general working of the Special Olympics Bharat-Tamil Nadu before the next date of hearing i.e., on August 20", the bench added.
