High Court lets student have MBBS seat

The bench said that under the physically handicapped quota, persons having 50 to 70 per cent of disability were eligible for admission.

Hyderabad: The High Court has directed the AP government, the convener of medical admissions and the NTR University of Health Sciences to give admission to Ms Shaik Shoyab Ali in the MBBS course based on his 62 per cent locomotor disability, his rank in Neet and his options in web counselling.

A division bench comprising Justice V. Ramasubramanian and Justice T. Rajani was dealing with the petition by Mr Ali after the university did not hold him eligible for admission into MBBS though he had qualified in Neet and was eligible for admission in the physically disabled category.

He told the court that the university had referred him to the medical board which at one time certified that he had 70 per cent disability and a second time put it at 80 per cent disability.

The bench said that under the physically handicapped quota, persons having 50 to 70 per cent of disability were eligible for admission.

The bench said that the court in its earlier order had made it clear that a candidate could be referred a second time for medical examination only when a doubt arises over the extent of disability. The cases cannot be referred for a second test based on other reasons.

The bench said that though the government had issued a GO to overcome the ruling of the court, the petitioner was eligible for the admission. Adjourning the case for two weeks, the bench said the admission would be subjected to the out come of the petition.
