Chennai: Contending that the argument that Assembly resolution is subject to judicial review does not hold water in all cases, the Congress whip S. Vijayadharani has demanded the TN government to reconsider its decision and adopt a unanimous resolution in the Assembly on permanently shutting Vedanta group’s Sterlite plant in Thoothukudi.
Raising the issue in the Assembly on Tuesday, Ms. Vijayadharani said the resolution on Sterlite closure if passed in the Assembly, contrary to what has been said, would grab the attention of the court to the issue.
“The Law Minister’s (C. Ve. Shanmugam) comparison of the resolution on permanent closure of Sterlite plant with the Assembly resolution (in 2011) seeking recommending commutation of death sentence for Rajiv Gandhi assassins which had gone to the court, are two different issues and does not hold water. In the resolution involving the assassination of former Prime Minister Rajiv Gandhi, the Supreme Court has asked the Centre to respond within three months to the Tamil Nadu government’s decision to release the seven convicts,” she said.
As an advocate she has been following several cases closely and in her opinion a unanimous resolution adopted in the Assembly ordering permanent closure of Sterlite's copper smelter plant would withstand judicial review, she claimed.
