Upa Lokayukta appointment: Karnataka High Court notice to govt

Samaj Parivartana Samudaya has filed the PIL on the ground that the appointment order is ultra vires the provisions of the Karnataka Lokayukta Act.

Bengaluru: The Karnataka High Court on Wednesday ordered a notice to the state government on a petition challenging the recent appointment of Justice (Retd.) B.S. Patil as Karnataka Upa Lokayukta.

The Samaj Parivartana Samudaya has filed the PIL on the ground that the appointment order is ultra vires the provisions of the Karnataka Lokayukta Act. The PIL states that as per the Act, the governor shall appoint the Upa Lokayukta on the advice of Chief Minister in consultation with the Chief Justice of the High Court, the Chairman of the Karnataka Legislative Council, the Speaker of the Karnataka Legislative Assembly and Leaders of the Opposition in the Karnataka Legislative Council and Assembly.

The petition alleged that Chief Minister B.S. Yediyurappa committed an error in not consulting the Chief Justice of the High Court while appointing Justice Patil as Upa Lokayukta.
