Supreme Court collegium has the final say

On complaints against elevation of advocates as judges, the collegium said, We find that the allegations made therein are frivolous''.

New Delhi: The Supreme Court collegium of judges headed by Chief Justice of India Dipak Misra has asserted its authority and supremacy in the appointment of judges of the High Courts observing that the professional competence cannot be determined by discreet inquiries by the Intelligence Bureau.

It said as regards comments touching upon integrity, the same are qualified by Intelligence Bureau’s own statement that “there is nothing on record to substantiate”.

On complaints against elevation of advocates as judges, the collegium said, “We find that the allegations made therein are frivolous and malicious in nature and appear to have been made with an ulterior motive to stall the proposed appointment. In our considered opinion, hardly any credence can be attached to such complaints, particularly in the light of positive views of our consultee-colleagues as to the candidates suitability.”
