Madras HC notice on plea for separate competitive exam for teachers
Chennai: A petition has been filed in Madras high court challenging introduction of a separate competitive examination by school education department for selection and appointment for the post of secondary grade teachers and BT assistants through the Teachers Recruitment Board (TRB).
Justice Satruhana Pujari, before whom the petition from Raji Priyadarshini of Arasupallipalayam in Tiruppur district and four others came up for hearing, ordered notice to the authorities concerned and adjourned the matter to September 14 for further hearing.
Advocate G. Sankaran, counsel for the petitioners, submitted that all the petitioners qualified with graduation degree and B.Ed degree. They are eligible for appointment to the post of BT assistants as per the special rules for TN school education subordinate service.
They appeared in Teacher Eligibility Test (TET) conducted by Teacher Recruitment Board (TRB) on April 30, 2017, and had secured pass marks. After certificate verification (CV) in July 2017, they were awarded weightage marks in the prescribed format for selection and appointment to the post of BT assistant teachers.
As they were waiting for appointment orders, the school education department issued the GO in July dispensing with the selection by awarding weightage marks. It introduced a separate competitive examination for selection and appoi-
-ntment to the post of secondary grade teachers and BT assistants through TRB.
Sankaran contended that the GO is illegal, arbitrary and against the law. It is liable to be quashed as it had been passed in violation of the provisions of Central Act — Right of Children to Free and Compulsory Education Act, 2009, and the regulations framed by the National Council for Teacher Education prescribing method of selection to the post of teacher and further taking away the accrued right of the petitioners based on the GOs in force.
