Subrahmanyam gets Hyderabad High Court relief in Emaar case

Justice Sankara Rao said the CBI had not placed any evidence to prove that the action of the petitioner had caused loss to the exchequer.

Hyderabad: The Hyderabad High Court on Thursday granted relief to senior AP IAS officer L.V. Subrahmanyam by quashing the charges framed against him by the CBI in the Emaar Properties case.

The CBI had charged Mr Subrahmanyam with extending undue favours to Emaar Properties while allotting the company la-nd during the tenure of the Y.S. Rajasekhar Reddy government regime as the then head the APIIC.

Justice B. Siva Sankara Rao was allowing a petition by Mr Subrahmanyam seeking to quash the cha-rges against him and challenging the action of the trial court in taking cognisance of the chargesheet against him though the government had refused sanction for prosecution.

While allowing the petition, Justice Sankara Rao said that the CBI had not placed any evidence to prove that the action of the petitioner had caused loss to the exchequer.

The judge noted that the state government had refused sanction to prosecute the petitioner in 2012. He pointed out in his 169-page judgement that though the Centre had accorded sanction to prosecute Mr Subrahmanyam in 2016, it was not done with proper procedure.
