Why no FIR on cops: Hyderabad High Court to Telangana government

Reacting to the submissions, the bench asked TS A-G D. Prakash Reddy why an FIR was not issued when the complaint made.

Hyderabad: The Hyderabad High Court on Tuesday asked the TS government explain why an FIR was not issued against the Sircilla district superintendent of police, sub-inspector of Nerella police station and 18 police personal on the complaint made by the victims of alleged police torture.

A division bench comprising Acting Chief Justice Ramesh Ranganathan and Justice G. Ganga Rao was dealing with a PIL by Gaddam Lakshman, president of civil liberties committee, seeking a CBI or SIT probe into the alleged torture of eight persons belonging to Dalit and BC communities, by the police at Nerella village of Sircilla district and also a taken-up case on the incident based on a letter from retired judge Justice B Chandra Kumar.

V. Raghunath, counsel for the petitioners, told the court that the victims had lodged a complaint with the DGP against the police officers responsible for the torture and also deposed against the police officers and personnel involved the torture before the IGP concerned. He alleged that despite the statement and complaint, no FIR was issued against the accused officials till date.

Reacting to the submissions, the bench asked TS A-G D. Prakash Reddy why an FIR was not issued when the complaint made.

The bench said that as per the law it is the duty of the police officers to issue an FIR when he receives a complaint and probe the matter and then file the final report before the lower court concerned if he finds that the complaint is false.

While informing the court that they have already suspended the sub-inspector concerned in this case, the A-G explained the health condition of the victims to the bench.

The bench asked the counsel for the petitioners to file an affidavit explaining the contents of the complaint made against the police officers alleged to have involved in the torture.

The bench asked the AG to file the affidavit explaining the reasons for not registering the case against the police personnel and adjourned the hearing.
