Plea to order CBI probe into RK Nagar bypoll malpractices

CHENNAI: A plea has been made in the Madras high court to order a CBI probe into the alleged electoral malpractices during the cancelled RK Nagar byelection.

Advocate M.P. Vairakkannan filed an additional affidavit to this effect on Thursday. Originally, Vairakkannan filed a petition to direct the police to register an FIR for bribing the voters during the RK Nagar by election and investigate the same and file charge sheet against the persons indicated by the Election Commission of India in its reply to his RTI query.

In his present additional affidavit, Vairakkannan submitted that when his petition came up for hearing on July 14, this court while pointing out that there was no progress in the investigation, had directed the Joint Commissioner (East) to monitor the investigation and file a status report and posted to August 23, further hearing of the case.

The case was registered by the Tamil Nadu State Police viz Abiramapuram police station and also the Joint Commissioner (east), who was directed to monitor the investigation was also under the control of the Tamil Nadu state police. The allegation in the petition was against some of the state ministers, including the chief minister. The state police come under one of the portfolios held by the Chief Minister. Hence, if the investigation was conducted by the state police the proper and fair investigation cannot be expected and the investigation will be under the influence of the state ministers against whom the report was submitted by the Income Tax department, he added.

He apprehended that if the investigation was conducted by the state police, it will not yield proper results since the state ministers including the CM are implicated. Hence, it was just and necessary to order the investigation of the case by some other agency particularly CBI, he added.
