Jail for drunk driving upheld

Lower court had ordered jail for repeat offender.

Hyderabad: Maintaining that drunken driving has become a menace to society and in many cases it was leading to causalities and innocent pedestrians were losing their lives, the Hyderabad High Court has upheld the conviction awarded by a lower court of the city, for one month simple imprisonment awarded to an offender who was caught for the second time.

Justice P. Keshava Rao while dismissing the criminal revision petition by D. Chandra Sekhar, seeking revision of the sentence by the Metropolitan Sessions Court of Hyderabad with Rs 3,000 fine on November 1, 2017 which was awarded by the 4th additional metropolitan magistrate, observed that the punishment awarded to a drunken driver should act as deterrent for others who were resorting to such type of violations.

While expressing disinclination to interfere with the punishment awarded by the lower appellate court, the judge said that the petitioner had violated the law and though no untoward incident had taken place, it cannot be said that the petitioner was not guilty of the offence nor could a lenient view be taken.

The High Court judge noted that in fact the petitioner had committed the same offence within two years.

The counsel for the petitioner submitted that the lower courts awarded the conviction without giving an opportunity of being heard.

Mr C. Pratap Reddy, public prosecutor submitted that the petitioner being an educated man, knew the law and no sympathy could be shown towards him.
