TSHB wins battle over 20 acres worth Rs 700 crores

Apex court rejects HC ruling that 20 acres were not acquired.

Hyderabad: After a prolonged legal battle over the title of 20 acres of land worth around Rs 700 crores the Telangana State Housing Board (TSHB) has ultimately won the case in the Supreme Court.

A division bench comprising Justice Madan B. Lokur and Justice Deepak Gupta while allowing an appeal by the Housing Board held that the entire Survey No. 1009 was acquired by the erstwhile AP Housing Board for a housing scheme and no parcel of land in Survey No. 1009 was left out or not acquired.

Stating that compensation had been paid for acquisition of the entire Survey No.1009, the apex court declared that the Division Bench of the AP High Court erred in concluding that 20.18 acres of land in Survey No. 1009 had not been acquired.

It said, “The surveys conducted post the notification under the Land Acquisition Act cannot be relied upon. We have also noted that IDL was also in possession of some parts of Survey No. 1009. We must accept that the entire Survey No. 1009 was acquired by the APHB regardless of its actual measurement and the alleged non-acquisition of 11.10 acres is just a red herring.”
