Out, Hyderabad HC tells temple land-grabbers

25 persons grabbed 1,536 sq. yards of Simhachalam Devasthanam.

Hyderabad: Ruling that the Land Grabbing Tribunal has no right to ask the land grabbers in a land grabbing case to retain possession and pay compensation at market value, the Hyderabad High Court ordered the people to evict from the land belonging to Simhachalam Devasthanam in Adavivaram of Visakhapatnam.

A division bench comprising Justice Nooty Ramamohana Rao and Justice B. Siva Sankara Rao, while allowing a petition by the executive officer of Sri Varahalakshmi Narasimha Swamy Devasthanam, Simhachalam of Visakhapatnam, challenging an order passed by the Special Tribunal for Land Grabbing at Visakhapatnam, has set aside the Tribunal’s order.

The temple had moved a petition before the Tribunal for eviction of Tutta Chinnayya and 24 others from 1,536 square yards of temple land. The Tribunal, while dismissing the petition of the temple, directed the executive officer to permit 25 person to continue in occupation of the site on payment of compensation of Rs 80 per square yard.

After perusing the provisions of the Land Grabbing Act, the bench held that though the Tribunal empowered to decide the title and ownership of land it has no power to allow retention of land grabbers on temple land by paying certain amount of compensation to the temple.

The bench, while allowing the petition, ruled that the order of the Tribunal is unsustainable under law and set aside the order. The bench dismissed a petition moved by Chinnaya and others challenging the action of the EO in refusing to receive payment from them as ordered by the Tribunal.

The bench ordered them to vacate the land in three months from the date of receipt of this order. Judicial officials allotted to AP, TS. The Hyderabad High Court has completed the provisional allocation of subordinate judicial officers among AP and Telangana states as per their population ratio of 52:48 as per provisions of the AP Reorganisation Act 2014.

The High Court Registry, after inviting options from judicial officers, allotted 335 district judges, senior civil judges and junior civil judges, besides 28 retired judicial officers to TS. AP was allotted 492 judicial officers in the rank of district judges, senior civil judges and junior civil judges besides 34 retired judicial officers.

The Registry, after publishing provisional allotments, invited objections, if any. Judicial officers were asked to submit their objections in a sealed cover to the district judges concerned by May 13 and the district judges were directed to forward the objections by May 18. According to the notification, officers who do not submit their options will be allocated to the states based on their domicile status available in their service records.
