Implementation of laws an issue: Supreme Court judge

Justice Chelameshwar introduced the audience to the doctrine of the Rule of Law' and requirements for its practise.

Hyderabad: Indian laws are on par with global standards but we have a problem with their implementation, said Supreme Court judge Justice Jasti Chalameswar on Monday at the Manthan Samvaad’s annual series of talks.

Justice Chelameshwar introduced the audience to the doctrine of the ‘Rule of Law’ and requirements for its practise.

He touched upon the importance of separation of responsibilities in creating the law, investigating the violation of the law, and enforcing the law and penalising violations.

“A judge who shares the valid reasons behind a judgement cannot be termed as honest, but a judge who doesn’t share the valid reasons also cannot be termed as dishonest at the same time, but yes sharing valid reasons for the judgement is quite important,” he stated.

He emphasised the need for civil society to participate more actively in adherence to the rule of law in order to prevent lawlessness.

He quoted the fourth US President James Madison: “If men were angels, no government would be necessary. If angels were to govern men, neither external nor internal controls on government would be necessary.”

“The prescription of the law in this country is on par with the rest of the world. The question is how well the law is being implemented in this country. It leaves a lot to be desired,” Justice Chalameswar said.
