Transport company to pay Tasmac Rs 39,000

The bottles were packed and entrusted to Southern Roadlines for transport. The goods were insured with Oriental Insurance Co. Ltd.

Chennai: A city court has directed a transport company to pay compensation of Rs 39,620 to Tasmac for damage of beer bottles during transit.

In the petition, Tamil Nadu State Marketing Corporation Ltd (Tasmac) and Oriental Insurance Co.Ltd submitted that Tasmac purchased a consignment of Max 11000 and Horse Power Super Strong Beer from Apollo Distilleries Pvt. Ltd. Gummidipoondi, Thiruvallur District for a cost of Rs 3,94,961 on November 11, 2013.

The bottles were packed and entrusted to Southern Roadlines for transport. The goods were insured with Oriental Insurance Co. Ltd. Due to an accident the beer bottles were delivered in a highly damaged condition at destination on November 16, 2013. Oriental Insurance Co.Ltd appointed S. Ravichandran as an Insurance Surveyor and Loss assessor, to conduct survey on the damages. In his report, Ravichandran stated that beer bottles worth Rs 39,620 were damaged during transit.

Ravichandran said that Tasmac suffered loss only due to negligence on the part of Southern Roadlines. As the roadlines refused to pay Rs 39,620, Tasmac and the insurance company approached the court seeking direction to the transport company to pay the amount along with interest of 12 per cent.

On completion of trial, the IV Assistant Judge M. Ilangovan has directed Southern Roadlines to pay the compensation of Rs 39,620 with interest.
