Chennai court restraint on TV serial producer
Chennai: A city court has restrained a famous Karnataka based television serial production company from entering into the office of horror television serial director.
In the petition, K. Balu, proprietor of Nimo Productions, said he produced horror television serial Adhu Vidaathu. P.V. Vijaya Bhaskar, chairman and managing director of Balaji Tele Talkies, Chikaballapur district, Karnataka, had promised to provide service in production and post production activities of 150 episodes of Adhu Vidaathu. This was expected to be telecast on Jaya TV. They had signed an agreement on October 22, 2013.
However, Vijaya Bhaskar failed to render services as per agreement and caused huge loss to Balu. Due to non cooperation and violation of agreement, the episodes were not given to the TV channel on time.
Subsequently, he lost the chance to telecast the serial and his reputation was affected. He incurred a loss of Rs 37.5 lakh. He contacted Balaji Tele Talkies’s agent and partner in Chennai on several occasions to settle the loss. The company was liable to pay him a compensation of Rs 36.5 lakhs and sent a notice. Bhaskar sent a reply on April 21, 2014, denying the liability. He also falsely claimed that he paid Rs 12 lakh to Balu and sought refund with interest. Bhaskar sent his henchmen in July 2015 to Balu’s office and threatened him.
Balu sought direction from the court seeking permanent injunction restraining Bhaskar’s men, agents, servants or any person claiming through them from entering into his office of the plaintiff and claiming Rs 12 lakh and not entitled to recover it in any manner other than the due process of law. Bhaskar remained absent.
The XVIII assistant judge, B.C. Gopinath, restrained Vijaya Bhaskar and his men from entering his office under the guise of claiming any amount without following the due process of law.
