ADGP Jangid gets Madras High Court reprieve

The single judge ought to have seen that Vidya had not made out a prima facie case.

Chennai: The Madras high court has stayed an order of a single judge, which ordered the maintenance of the status quo in the matter relating to the promotion of ADGP S.R. Jangid, IPS.

A division bench comprising Justices Huluvadi G. Ramesh and G. Jayachandran who granted the interim stay also ordered notice to the Union home secretary and state government on an appeal filed by ADGP Jangid, which sought to set aside the order of a single judge.

On a petition filed by V. Vidya of T. Nagar, Justice S.M. Subramaniam had on July 31 ordered the maintenance of the status quo until August 7in the matter relating to the promotion of ADGP Jangid.

In his appeal, Jangid submitted that the single judge failed to consider that Vidya has filed the petition by making unsubstantiated allegations and that there was no enquiry or disciplinary proceeding pending as against him and when no such enquiry or disciplinary proceeding was pending, he cannot be deprived of his promotion. The single judge ought to have seen that Vidya had not made out a prima facie case. The single judge has passed the non-speaking order without considering that Vidya was an accused in several criminal cases, including a case registered by CBI, pending before the respective courts, he added.

Jangid said the single judge has passed the order without considering that Vidya had sent several representations with the same allegations made in her petition to various authorities and all her representations were thoroughly enquired by various authorities, including the DGP-CBCID and that he was cleared of all allegations levelled by her. The single judge had not even assigned any reason as to why the order of the status quo has to be passed and it has been made without any discussion as to the necessity to pass such an order without even notice to him. The single had failed to consider that Vidya had not arraigned him as a party to any proceedings initiated by her and that there was nothing against him in any of the orders referred to by her, Jangid added.
