Solar scam: Saritha Nair moves Kerala High Court to implead petition
KOCHI: Solar scam-accused Saritha Nair has approached the High Court seeking permission to implead in the petition filed by former chief minister Oommen Chandy to annul the solar commission report and further proceedings in the matter. The petition filed by Saritha on Friday pointed out that since the commission was set up on an issue in which she was involved she needed to be given an opportunity to present her version in a petition questioning the findings of the commission.
She has also said that the petitioner was now questioning the legal validity of a commission set up by his own government. The petitioner was trying to run away from the responsibilities under section 226 of the Constitution. She also said that the former CM had attended the hearing of the commission and had approached the court to quash the report as the findings went against him.
The court has posted further hearings in the case to March 8.
Mr Kapil Sibal, counsel for the former CM, completed his primary arguments in the case on Friday. The counsel for the government in his argument stated that the commission was appointed as per the decision of the then cabinet. He has also submitted the documents in this regard, including the copy of the cabinet decision. The counsel for Mr Chandy will have an opportunity to reply to the arguments of the government counsel later. Mr Sibal had questioned the very legal basis of the commission the other day.
