High Court gives Telangana 10 days on Azaan

It was functioning and there would not be any difficulties for the students to attend the ensuing examinations.

Hyderabad: The Hyderabad High Court on Monday directed the school education officials to take a decision in accordance with law on the representation of a father of one of the students of Azaan School to take the institution under its direct management within 10 days.

Justice A. Rajasheker Reddy was dealing with a petition filed by Mr Mir Yousuf Ali, the father of one the students of the school, seeking complaining against the inaction of the education principal secretary and Commissioner of School Education in taking action against the school chairman and principal for running the school in violation of AP Educational Institutions Rules, 1993 and in violation of GO Ms. No. 1 of 1994 as illegal.

Mr D. Prakash Reddy, senior counsel, appearing for the school management submitted that the allegation of the petitioner was false. It was functioning and there would not be any difficulties for the students to attend the ensuing examinations.

He urged the court to dismiss the petition on the ground of maintainablilty as the petitioner had moved the court without representing the authorities about his grievance.

Mr Abdul Mateen Qureshi, counsel for the petitioner, said the school was running under the management which had been facing charges of not having safety measures.

He submitted that the petitioner being the father of a student had the right to move the court directly for safety of his child.

He said that as per Section 3(a) of the Education Act, the school education authorities have the power to appoint special officer when they received representation about mismanagement till reconstitution of the management.

While directing the petitioner to represent the authorities, the judge directed the management of the school and authorities to file the counter affidavits by October 10.
