Madras HC asks Dharmapuri CB-CID to probe case

The matter pertains to a school student Kavia Arasan filed seeking compensation for the accident occurred on July 3, 2009.

Chennai: Madras high court has directed CB-CID of Dharmapuri district to conduct investigation into a complaint of submitting fake accident insurance policy to receive compensation from a Motor Accident Claim Tribunal (MACT) in Harur.

When an appeal filed by HDFC Ergo General Insurance Company Limited came up for hearing, Justice M.V. Muralidharan said, “I have gone through both the insurance policies filed by the claimant and the insurance company and the policy filed by the claimant has not tallied with the model policy filed by the insurance company.

Therefore, there is a valid point by the insurance company that based on the fake insurance policy the claimant has filed the claim before Motor Accident Claim Tribunal (MACT) and in fact the Tribunal also without going into the documents in a proper manner has passed award.

Therefore before going into the merits, this court wants go into the validness of the Policy filed by the claimant by comparing with the Model policy filed by the Insurance Company, since it is the case of Insurance Company that the fake insurance policy was produced by the claimant.

Therefore, I am inclined to direct the Police Inspector, CB-CID, Dharmapuri District to register an FIR and investigate about the validness of the Policy of Kavia Arasan, vehicle No: TN-30-L-6242 along with the model policy filed by the Insurance company and file a report on or before September 25, 2018.”

The judge passed the interim order on appeal from the insurance firm challenging the decree by the MCAT Judge Harur dated September 16, 2014. The matter pertains to a school student Kavia Arasan filed seeking compensation for the accident occurred on July 3, 2009.

On behalf of Arasan, his father filed the petition before the Tribuanl. When Arasan, was riding a cycle on July 2, 2009, a Bajaj Discover bike belonged to Neelamegam of Salem district dashed against the cycle. The boy sustained injuries and underwent surgery in a private hospital at Salem.

The MCAT Judge passed an award granting a sum of Rs 1,36,500 as compensation to be paid by the insurance company. Challenging the decree the insurance company filed the present petition.
