Telangana: Land sharks use courts to harass genuine owners
Hyderabad: Genuine owners of property have been suffering with litigations by land grabbers for years. In some cases, the Supreme Court ruled in favour of the owners but illegal constructions at the site continue to plague them.
A retired employee from secretariat purchased a plot in a colony under Manikonda 15 years back. When he visited the plot, someone had constructed a house. They claimed to be the owners of the land and had registration documents. Later, the victim came to know that the developer of the colony cheated him by selling the same plot to others.
An RTI activist from Manikonda P. Suresh said the victim approached District Court, High Court and even Supreme Court of India. “The developer initially registered the plot on the victim’s name but later without his knowledge, he cancelled the registration and sold it to others. The final judgement in SC was in his favour and he got justice after 15 years struggle. Now, both the developer and plot owner are on a compromise. In order to implement the SC orders, he needed to approach court once again,” he said.
Mr. Tirunagari Venkata Ramana, an advocate dealing with civil cases said that judiciary system was leading to delay.
“As per the rules, courts give 90 day time to opposite party for filing counter petitions and 30 days for appeal. Besides this, anyone including Plaintiff or Respondent or Witness or advocate of any one party fails in attending court, the judge adjourns the arguments. Transfers of judges will lead to more delay in case as new judge should study the case. Apart from these reasons misplacing of files, vacations of courts, delay in serving summons to witness or the witness not accepts it intentionally etc., are leading delay of cases,” he said.
He said that the judiciary system should adopt technology like Whatsapp, Skype, email etc., in serving summons and should take help of Advocate Commissioner in cases of either party or witness caught sick.
T. Narsimha Reddy, ex-president of Secunderabad Court’s bar council said that High Court had earlier issued circulars for completing cases early in cases of senior citizens. “If the petitioner is senior citizen, he can ask the judge on the circular for a quick judgement. Most of the citizens are not having awareness on the circular,” he said.
ACB continues raids on TS sub registrar offices
The Anti-Corruption Bureau on Thursday continued its raids on sub-registrar offices in Hyderabad and other districts.
An official source said that 10 teams deputed for the raids were gathering information from the offices. “We are gathering transactions and registrations of documents information that will be compiled and the stamp duty and capital gain details ascertained before taking an action. Seven teams are working outside GHMC and three are in GHMC,” the source said.
Talking about the searches at three arrested sub registrars’, the source said, “Our teams are observing the issue. Once we collect all the evidence, we’ll register cases.”
