Madras high court dismisses challenge to TNHB notice to vacate
Chennai: The Madras high court has dismissed a batch of appeals from the residents of Todhunter Nagar Housing Board, challenging the notices issued by the Tamil Nadu Housing Board to them, asking them to vacate and hand over the vacant possession of the tenements in which they were residing.
A division bench comprising Justices T.S.Sivagnanam and V.Bhavani Subbaroyan however set aside the order of the TNHB, cancelling the alternate accommodation granted to the government servants who were granted allotment under the TNGRHS at Thirumangalam.
The government servants who have been granted alternate accommodation at Thirumangalam are granted time till April 30, 2019 to shift to Thirumangalam and if they failed to do so, the benefit of this order will not enure in their favour and the cancellation of allotment of alternate accommodation, dated February 11, 2019 and other similar orders will automatically stand reviewed and the government/TNHB shall forthwith allot the same to other government servants, who are wait listed for accommodation, the bench added.
The bench said the appellant who secured allotment under public quota were granted time to vacate and hand over vacant possession of the respective accommodation on or before April 30, 2019. If the appellants fail to do so, the authorities are directed to dispossess them and if necessary with the police aid.
