TRS appeal against MLAs' expulsion not maintainable'

The order could be challenged by either the Speaker or the Secretary of the Assembly.

Hyderabad: Supreme Court lawyer Abhishek Singhvi pointed out that the appeal filed by TRS MLAs against a single judge’s order setting aside the expulsion of two Congress MLAs from Assembly was not maintainable. The order could be challenged by either the Speaker or the Secretary of the Assembly.

Mr Singhvi appeared on behalf of Congress MLAs Komatireddy Venkat Reddy and S.A. Sampath Kumar before a division bench comprising Acting Chief Justice Ramesh Ranganathan and Justice K. Vijaya Lakshmi.

The bench heard arguments for and against the maintainability of an appeal filed by 12 TRS MLAs challenging an order passed by a single judge that set aside a resolution passed in the Assembly for the expulsion of the two Congress MLAs.

Mr Singhvi pointed out that the TRS MLAs were not authorised to file the appeal, and asked why only 12 MLAs were challenging the order when the resolution had been passed by 121 MLAs. He argued that the order passed by the single judge did not harm the MLAs concerned, the House, or the interests of the public. He said that the case involved several issues that required a detailed hearing. The hearing will continue on Wednesday.
