Hyderabad High Court rejects dalmia plea on summons

Issued by the Enforcement Directorate in connection with the illegal investments case of Y.S. Jagan Mohan Reddy.

Hyderabad: Justice Vilas V. Afzulpurkar of the Hyderabad High Court on Monday dismissed a plea of Dalmia Cements challenging the summons issued by the Enforcement Directorate in connection with the illegal investments case of Y.S. Jagan Mohan Reddy.

Dalmia Cements MD Punith Dalmia had moved the plea challenging the summons issued by the ED under provisions of the Prevention of Money Laundering Act to appear before the investigation officer.

Appearing for the petitioner, Mr P. Chidambaram, contended that the investigating agency could summon the accused only till the probe stage but in this case the chargesheet had been filed and the agency had no right to summon his client.

Additional solicitor general G. Rajagopalan, appearing for the ED, contended that Section 50 of the PMLA Act empowered the investigation officer to summon a person for recording evidence.
