Kerala High Court refuses CBI probe into rape-murder of Jisha
Kochi: Kerala High Court on Monday refused to order a CBI probe into the rape and murder of Jisha, 30, of Perumabvur. A division bench comprising acting Chief Justice Thottathil B. Radhakrishnan and Justice Anu Sivaraman dismissed a plea seeking a CBI probe after considering the government order constituting a new Special Investigation Team headed by B. Sandhya, Additional Director-General of Police (South Zone).
The court dismissed the pleas filed by Dravida Jana Charitable Samithy, Alappuzha, and T.B. Mini. The petitioners argued that the police had not followed the provisions of the Criminal Procedure Code at the initial stage of investigation.
Senior government pleader C.Rasheed submitted that a new SIT of seven officers headed by B. Sandhya had been entrusted with the investigation of the case. Recording the submissions, the court observed, “it was the duty of the police to do everything needed in accordance with law to ensure that there was fair and complete investigation into all aspects of the incident and conclude the probe in accordance with the law.”
The petitioners pointed out various discrepancies, including absence of an executive magistrate during inquest and lack of video recording of the same. They also sought legal action against the sub-inspector of police, Kuruppampady, and the Aluva Rural SP and other officers.
Certain petitioners had also pleaded that if the investigation could not be handed over to a special team headed by a woman police officer, the investigation be handed over to the CBI.
Govt job for Jisha’s sister
The government on Monday issued orders providing a job to K.P. Deepamol, sister of Jishamol, who was murdered at Perumbavoor last month. Deepamol has been appointed as attendant at Kunnathunadu taluk office. The orders were issued by chief secretary S.M. Vijayanand who directed the Ernakulam collector to take steps to execute the order.
In its first decision soon after taking office, the LDF government had constituted a SIT to probe the murder besides announcing steps for the rehabilitation of Jisha's family, including job for her sister and construction of their house in a time-bound manner. The cabinet had also decided to grant Jisha’s mother a monthly pension of Rs 5000.
IG files petition against SPCA summons
Ernakulam Range IG Mahipal Yadav has filed a petition before Kerala High Court challenging the summons issued by State Police Complaints Authority (SPCA) in connection with the probe into Perumbavoor law student rape and murder case.
The petitioner argued that police as been conducting a very sincere and honest investigation into the case.
Scientific evidence were collected about the accused and the investigation is in the right path. The petitioner argued that the Police Complaints Authority has no authority to entertain a petition alleging discrepancies in the investigation,
The police complaints authority issued the summons stating that Ernakulam Range IG and others had deliberately disobeyed the summons and had posted the case on June 2. According to the cop the state government meanwhile constituted a new investigation team headed by Sandhya ADGP and he has no role in the present investigation.
