Telangana HC Orders Status Quo on Gated Community Wall

There was a dispute between residents of different phases over the use of amenities

Hyderabad: Justice B. Vijaysen Reddy of the Telangana High Court on Monday directed the panchayat raj department at Gowdevalli village, Medchal, to maintain status quo with regard to a writ petition filed by Saket Engineering Pvt. Ltd. The petitioner sought directions against the construction of a compound wall in Saket Bhu Sattva, a gated community project, without considering their responses. The project is an integrated gated community. There was a dispute between residents of different phases over the use of amenities, for which the panchayat secretary directed the construction of the compound wall. The matter will be heard on November 6.

Firm challenges Sarfaesi rule

A two judge bench of the Telangana High Court comprising Chief Justice and N.V. Shravan Kumar ordered notice in a writ plea challenging Rule 9(5) of security interest (enforcement) rules of the Sarfaesi Act. Writ petitioner Aditya Infrastructure said it had deposited 25 per cent of the amount for the purchase of five acres in Bibinagar, Nalgonda district in an auction. It was disenabled from paying the balance as the property was prohibited from alienation. However, the earnet money was forfeited. The petitioner said the property ought not to have been put for auction.

NGO fined for wrong facts

Justice T. Vinod Kumar imposed Rs 25,000 costs on a petitioner, Compassion in Action, for suppressing facts in its writ on alleged official inaction against an allegedly illegal construction. The money is to be deposited with the State Legal Services Authority. The petitioner had complained that officials were allowing a five-storey structure where the sanctioned plan was for three floors. The officials denied that was the case. Justice Vinod Kumar said that a person coming to court with unclean hands is not entitled to relief in public law.
