Hyderabad: The president of Hyderabad District Consumer Disputes Redressal Commission-I B. Uma Venkata Subba Lakshmi directed Narne Estates private limited to collect the pending 12 monthly installments (Rs 750 per month) and register the plot in the name of their customer or his nominee.
A 64-year-old retired employee G Satyanarayana Murthy from Boduppal in a petition filed with the commission said that he had purchased an open plot (membership No. 26303) measuring 250 sq. yds., in the company’s ‘East City’ project at Bibinagar in 1996. A monthly payment of Rs 750 was to be made in 60 installments.
The complainant paid an amount of Rs 36,700 in 48 installments till July 2000.
He had to stop further payments as he lost his job as clerk-typist in Sri Sai Ranga chit fund pvt. ltd. He urged Narne Estates to register the plot in his name by taking the remaining 12 installments.
However, they ignored his plea, leaving him distressed. After pursuing the matter for nine years to no avail, he issued a legal notice to the company, which also did not evoke any response.
Narne Estates filed a counter affidavit stating that the complainant had enrolled in their ‘one crore gold’ and had won the third prize of gold earrings worth Rs 10,000.
The particular scheme mandates that the prize winners have to continue their membership and pay installments till the end of the scheme, it said.
After hearing arguments from both counsels, the commission directed the firm to collect the remaining 12 installments’ amount and register the plot in the name of the complainant or his nominee and pay damages of Rs 10,000 for causing mental agony and another Rs 5,000 towards costs.
