Andhra Pradesh intentionally delaying separate High Court, claims Telangana
Hyderabad: Mr Sarasani Satyam Reddy a leader of Telangana Advocates Joint Action Committee said that the earlier court order of the High Court to set up HC in six months will not come in way for setting up the separate High Court of AP.
He reminded that the Centre and the Supreme Court have recently approved the allocation of judges among both states and now it is for the AP to request the Centre to issue notification for the constitution of the HC as they are prepared to provide the temporary infrastructure.
He said as per the provisions of the AP Reorganisation Act 2014, the Centre has to request the President of India to issue notification soon after it receives request from the AP.
He alleged that the AP government is intentionally delaying the issue for reasons better known to it and if things like this are allowed the long pending demand of having separate High Courts for AP and TS will not become realty prior to elections in 2019.
The AP government recently finalised the design for “Justice City” of Amaravati wherein the new court building will come up.
Before finalising the designs a team of judges of the Hyderabad High Court visited the land earmarked for the Justice City and gave approval to the state government to go ahead with the proposal.
According to officials of the AP government, High Court building will be constructed as G+4 and will cost about '450 crore. They stated that though designs are finalised, there is a lengthy process involved before commencing of the actual construction.
Mr Dammalapati Srinivas, advocate general of AP said keeping in view of the delay in providing permanent infrastructure for the High Court, Chief Minister N. Chandrababu Naidu recently instructed them to find out temporary accommodation to set up the HC.
He said their officers are right now in search of suitable buildings which will accommodate not only the High Court but also the residences of judges.
Subject to the provisions of Section 30 of the AP Reorganisation Act 2014, there shall be a separate High Court for the State of AP (hereinafter referred to as the High Court of Andhra Pradesh) and the High Court of Judicature at Hyderabad shall become the High Court for the State of Telangana (hereinafter referred to as the High Court at Hyderabad).
The Act 2014 says that the principal seat of the High Court of Andhra Pradesh shall be at such place as notified by the President.
The Act 2014 also says the Judges and division courts of the High Court of AP may sit at such other place or places in the state other than its principal seat as the Chief Justice may, with the approval of the Governor of AP.
