Chennai: Forum asks dealer to pay Rs 5.83 lakh for damaging car
Chennai: The District Consumer Disputes Redressal Forum, Chennai (North), has directed a dealer of a famous car firm to pay a compensation of Rs 5.83 lakh for damaging the car sent for repair. In the petition, P. Murugesan, director, Pioneer Aero Travels (M) Pvt. Ltd., Nungambakkam, submitted that he booked a ‘Ford Eco Sport’ Car and paid Rs 11,53,939 to M/s. Chennai Ford, Arumbakkam.
On October 31, 2014, he noticed some malfunctioning in the clutch and gear in the vehicle. He immediately alerted the Ford India about the breakdown. The car was towed by Ford India road assistance cell to the service centre. At the time of towing the vehicle, there was no dent or any scratches on the vehicle. When he visited dealer he noticed that there were several dents and scratches all over the car. The firm assured that they would set right such defects. He insisted for a refund of the total cost of the vehicle. On February 11, 2014, the Ford India agreed to pay a sum of Rs 9 lakh as against the total of Rs 11,53,939 paid by him.
On information from dealer, he handed over the original RC Book, duplicate key and service book. The dealer paid Rs 8.01 lakh to HDFC Bank, after selling the car the dealer paid the loan amount to the bank and also has a DD for the balance of Rs 98,737 to be paid to the complainant. Hence, the managing director sought to dismiss the complaint. The bench comprising president K. Jayabalan and member M. Uyirroli Kannan has directed managing director, M/s. Chennai Ford, Arumbakkam, to pay Rs 5.83 lakh to him towards booking amount, exchange car value, payments made towards EMI and compensation.
