CM Yadav Explores legal Measures To Restore 27 Percent OBC Quota, May Move Supreme Court

The chief minister returned to Madhya Pradesh after the brief engagement with Mr. Mehta: Reports

BHOPAL: Chief minister Mohan Yadav on Tuesday started exploring legal measures to restore the 27 percent quota of the Other Backward Class (OBC), struck down by the Madhya Pradesh high court last fortnight.

Mr. Yadav made a short visit to New Delhi in the morning to discuss the matter with the Solicitor General of India Tushar Mehta to explore the possibility of taking the matter to the supreme court to restore 27 percent OBC quota in the state, officials said.

Advocate General of Madhya Pradesh government Prashant Singh was present on the occasion, sources said.

The chief minister returned to Madhya Pradesh after the brief engagement with Mr. Mehta.

The Madhya Pradesh high court had rejected the pleas seeking to increase the OBC reservation from the present 14 percent to 27 percent on the ground of breaching the 50 percent cap.

The then Kamal Nath government in March 2019 had promulgated an ordinance increasing the OBC quota from 14 percent to 27 percent.

The move was later challenged in the Madhya Pradesh high court forcing the previous Shivraj Singh Chouhan government to adopt a formula in which 14 percent OBC quota in vacant government posts was filled while keeping the remaining 13 percent reserved posts on hold, pending disposal of the case in the court.

The high court, while pegging the OBC quota at 14 percent, has directed the state government to fill the remaining vacant posts, reserved for the OBC, by de-reserving them.

Mr. Yadav also called an all-party meeting here a couple of days ago to thrash out a solution to the issue.
