The recent heartbreaking bike taxi accident in Delhi highlights a critical question: Are passengers protected?

New Delhi: In a tragic accident, a 26-year-old woman riding pillion on a bike taxi was killed after the two-wheeler skidded on the Shahdara flyover, according to the Delhi police. The deceased has been identified as Neelam, a resident of Karawal Nagar who was on her way to work in the Jhilmil area when the accident occurred. Police said they received information from GTB Hospital regarding the admission of a woman with multiple injuries.
During the inquiry, it was found that Neelam had hired a bike taxi to reach her workplace when the two-wheeler allegedly skidded on the Shahdara flyover, causing her grievous injuries, to which she later succumbed. A case has been registered against the rider, identified as Dharamvir, who has been apprehended. Further investigation is underway as police are examining CCTV footage from the area to ascertain the sequence of events leading to the accident.

Under the Motor Vehicles Act, every commercial vehicle (cab, auto, or registered bike taxi) must have Third-Party Liability Insurance. As a fare-paying passenger, the law categorizes you as a "Third Party" concerning the vehicle's insurance policy. The insurance company of the vehicle is legally bound to pay compensation in case of a passenger's injury or death.
The Rideshare App Policy is an additional safety net active from the exact moment your trip starts until it ends where major taxi aggregators (Uber, Ola, Rapido) automatically bundle Passenger Travel Insurance into your fare at no extra cost. It covers accidental death, permanent/partial disability, and emergency medical hospitalization expenses.
Compensation is decided through the app Insurance which usually has a fixed cap (typically up to ₹5,00,000 for death or major disability). According to the Motor Accident Claims Tribunal (MACT), families can file a case in court; by law, third-party liability for death or bodily injury has no upper limit, and the court determines the payout based on the victim's age, income, and family dependants.
Insurance can be refused if a rider uses a private white-plate vehicle as an illegal commercial taxi; standard insurance can legally deny the claim.
If the driver is operating without a valid commercial permit, fitness certificate, or driving license, it heavily complicates the legal battle.
However, courts usually order the insurance company to pay the victim first and recover it from the owner later.
What to look for before you ride: Always book through official apps so the digital trail (trip ID) exists. For bike taxis, insist on a helmet.
