Nalgonda Court Sentences Car Diver to 20 Years of RI for Raping Minor Girl

The court asked the Secretary of District Legal Services Authority to take steps for paying compensation of Rs.7 lakh to the victim girl at the earliest.

Hyderabad: A local court in Nalgonda district on Tuesday sentenced a car driver to 20 years of rigorous imprisonment (RI) for raping a minor girl in 2021.

The verdict was delivered by N. Rojaramani, Additional District Judge-II and SC, ST Court judge in Nalgonda. She is also full additional charge of the fast track court for POCSO Act cases in the district.

The court held the accused Shaik alias Mohammed Khayyum (20), a car driver and resident of Nakrekal Road in Thipparthy Town held guilty in the case. As the victim girl was a child at time of offence, the accused is sentenced to undergo RI for 20 years and to pay a fine of Rs.25,000 under Section 42 of POCSO Act. In default of payment of fine amount, he shall suffer simple imprisonment for six months.

He was further sentenced to undergo simple imprisonment for 10 years and to pay fine of Rs.25,000 in default of payment of fine amount he shall suffer simple imprisonment for six months for the offence under Section 366 of the Indian Penal Code (IPC). He was further sentenced to undergo simple imprisonment for one year and to pay fine of Rs.5,000 in default of payment of fine, he has to further undergo simple imprisonment for one month.

The accused was further sentenced to undergo RI for 20 years and to pay a fine of Rs.25,000 and in default of payment of fine amount, he shall suffer simple imprisonment for six months. All the sentences would run concurrently, said POCSO Court Special Public Prosecutor, Vemula Ranjith Kumar.

The total fine amount of Rs.80,000 shall be paid to the victim girl towards compensation for her pain and suffering. The court was of the considered opinion that the victim girl has to be compensated for her suffering both physical and mental and as such an amount of Rs.7 lakh was decided as compensation amount.

Therefore, the Secretary, District Legal Services Authority, was directed to take steps for payment of the compensation amount of Rs.7 lakh to the victim girl at the earliest.
