SC Rejects PIL Seeking Menstrual Leave Policy Across Country

During the hearing, the Chief Justice raised concerns about the potential social consequences of mandating menstrual leave through legislation

New Delhi: The Supreme Court on Friday declined to entertain a PIL seeking a nationwide policy mandating menstrual leave for women students and employees, observing that such a move could unintentionally reinforce gender stereotypes and affect women’s employment prospects.

A two-judge bench of Chief Justice of India Surya Kant and Justice Joymalya Bagchi said that if menstrual leave is made compulsory by law, employers might hesitate to hire women.
However, the court said the competent authorities may examine the issue and consider the representation for framing an appropriate policy after consulting stakeholders. The bench disposed of the PIL with directions to the authorities to take a decision on the representation.
The petition was filed by Shailendra Mani Tripathi.
During the hearing, senior advocate M.R. Shamshad, appearing for the petitioner, pointed out that some states and institutions have already introduced menstrual leave provisions. He cited Kerala, where relaxations have been provided for students, and noted that several private companies have voluntarily granted such leave.
The Chief Justice said that voluntary provisions are welcome, but making menstrual leave compulsory through legislation could have unintended consequences. The court also noted that such measures could influence workplace perceptions and potentially impact women’s career opportunities.
