Supreme court clears Jose Thettayil in sex tape case

The HC also had severely criticised the act of the women who moved against Thettayil.

Kottayam: The Supreme Court on Thursday rejected the appeal filed by the state government against Jose Thettayil MLA challenging the Kerala High Court order in the controversial sex tape case.

The High Court had dismissed a petition alleging sexual harassment against Thettayil.

A division bench of the apex court observed that the charges levelled against the MLA were politically motivated and aimed at trapping the JD (S) leader.

“Sleeping with an old man to enter into a wedlock with his son is something that is unheard of. It was the woman who had invited Jose Thettayil to the flat and the intimate moments were captured on a camera. So it cannot be said that Thettayil had raped the woman," the court held.

In the complaint, the woman says that she had decided to teach Thettayil a lesson, the court found.

The High Court also had severely criticised the act of the women who moved against Thettayil.

She alleged that both Thettayil and his son raped her promising that Thettayil's son will marry her.

The plea filed by Thettayil's son is pending before the High Court.
