Kochi: Kerala High Court on Thursday reserved its order on the bail application of actor Dileep in the actress assault case. The Special Investigation Team probing the case submitted before the court that Dileep, eleventh accused, was the 'kingpin' in the case. It argued that it was for the first time in the history of criminal law that a quotation had been given for committing rape. The SIT had collected sufficient materials and evidence against Dileep to prove his involvement in the crime. The telephone call records and deposition of eyewitnesses confirmed his role, the prosecution said.
Dileep had met Suni more than four times at different places. The original mobile phone and the memory card containing the assault visuals are yet to be recovered. The police had only recovered a memory card containing the visuals copied from the original card. The petitioner reiterated that there were no materials to implicate him. Without conducting an inquiry, solely based on a statement of Pulsar Suni, who is a notorious criminal involved in a number of abduction and robbery cases, he had been arraigned as accused, arrested on July 10 and since then has been in judicial custody.
According to the state, Dileep, if released on bail, will influence the witnesses to sabotage the investigation and trial. A number of leading film actors and film-related persons have been questioned and their statements were recorded. Suni had told the police that they had continued the conspiracy to commit the offence at various film shooting locations. The revelations of Pulsar Suni have been confirmed by mobile phone tower locations and through witness statements, the state submitted.
