Madras High Court declines to interfere with notice issued to Ashram school

The judge said additional government P. Sanjaigandhi submitted that the inquiry would be postponed.

Chennai:The Madras high court has declined to interfere with a showcause notice issued by the Directorate of Matriculation Schools to the Ashram Matriculation Higher Secondary School based on the complaint given by the landlord of the school against the management of the school. Disposing of a petition from the school, Justice M.M. Sundresh gave liberty to the school to attend the hearing before the Directorate of Matriculation Schools and put forth its case.

The judge said the impugned showcause dated January 12, 2016, has been issued in pursuance to the complaint given by the landlord against the petitioner school alleging that there was fundamental violation said to have been committed by the school.

As there was no action forthcoming, he approached this court, which gave liberty to him to approach the authorities and when such a complaint was made, the authorities shall take appropriate action. In compliance of the order of this court, the Directorate of Matriculation Schools issued a notice to the school to put forth its case. Challenging this notice, the petitioner has filed the present petition.

“Admittedly, the petitioner (school) cannot be said to be an aggrieved person at this stage. There is no material available to hold the lack of jurisdiction of the Directorate of Matriculation Schools”, the judge added. The judge said additional government P. Sanjaigandhi submitted that the inquiry would be postponed. Accordingly, the Directorate of Matriculation Schools was directed to intimate the next date of hearing, so as to enable the petitioner to attend the hearing and put forth its case.
