Mohammed Nisham may spend whole life in prison

Under various counts the judge has awarded 24 years in prison for Nisham.

Kochi: Unless the government grants an early remission Beedi Tycoon Muhammed Nisham will have to serve his entire life inside a central prison in the state.

If the government decides to give a remission after 14 years Nisham will have to serve 38 years in prison as the imprisonment awarded by Additional Sessions Judge K P Sudhir is not a concurrent sentence.

Under various counts the judge has awarded 24 years in prison for Nisham. A concurrent sentence is when sentences on more than one crime "run" or are served at the same time, rather than one after the other.

In various orders the apex court had made it clear that the life term awarded to an accused under section 302 (murder) is prison term for the end of life.

Considering the gravity of the case the judge awarded maximum imprisonment for the accused under all the sections he has been charged with.

Nisham would be eligible for his first parole after serving two and a half years in jail. Since he was arrested in January 2015 he would be eligible for a parole in June 2017.

All the convicts are eligible for a parole of 60 days ordinary parole and 45 days of emergency and sick leave for additional 5-8 days.
