Telangana HC Restrains HYDRAA from Interfering in Madhapur Land Possession
The judge was hearing separate writ petitions filed by Y. Jagal Reddy and Y. Venkat Reddy, who alleged illegal interference by HYDRAA and the GHMC in their housing plots in the land.
Hyderabad: Justice B. Vijaysen Reddy of the Telangana High Court on Tuesday restrained HYDRAA and other authorities from interfering with the possession of around 2,000 square yards in Survey No.s 66 and 67 of Madhapur, Serilingampally mandal.
The judge was hearing separate writ petitions filed by Y. Jagal Reddy and Y. Venkat Reddy, who alleged illegal interference by HYDRAA and the GHMC in their housing plots in the land.
One of the petitioner sought protection over Plot No. 3, admeasuring 1,190 sq. yds., purchased in 1998 and regularised under GO 456 dated March 26, 2008. He alleged that HYDRAA attempted to take “symbolic possession” of his land at 3 am on August 21 without notice and also sought damages of ₹50 lakh. Counsel for HYDRAA argued that the Jubilee Enclave Owners’ Welfare Association had complained that the land was earmarked as a park. The agency had issued a notice in January seeking ownership documents, to which the petitioner furnished a detailed reply along with supporting records.
After examining earlier court records and government documents, the High Court observed that prima facie the petitioner held valid title and that the land was not classified as a park. The court directed HYDRAA to remove sign boards erected on the site and adjourned the matter to September 18, when it will be heard along with similar cases.
Venkat Reddy, owner of Plot No. 4, measuring 845 sq. yds, complained that HYDRAA demolished his watchman’s room and compound wall without notice. His counsel sought parity with the earlier order. Accepting the plea, the court directed HYDRAA not to disturb his possession and to remove sign boards placed on his land as well.
