Telangana HC Disposes PIL on Alleged Encroachment of Airport Land

Hyderabad:The Telangana High Court on Monday disposed of a PIL that alleged encroachment of 97.06 acre of airport land in Mankhal, Thukkuguda municipality, by the real estate firm Vertex Developers LLP.

Kukkala Krishna, a fisherman from Tukkuguda, had filed the PIL stating that the authorities were not responding to his representations or complaints made against the firm who, he alleged, had encroached on government land for its Vertex KLR Giga City project.

A division bench comprising Chief Justice Aparesh Kumar Singh and Justice G.M. Mohiuddin declined to adjudicate the PIL on merits, observing that the pleadings were incomplete and lacked authenticated material particulars. The bench noted that the petitioner failed to furnish specific details regarding the exact extent of land allegedly encroached, the survey-wise description, and the nature of permissions obtained by the developer from statutory authorities such as HMDA and RERA.

The bench observed that in the absence of such essential particulars, neither the could the court nor the statutory authorities be expected to take action.

The court directed the petitioner to submit a comprehensive representation before the Rangareddy district collector along with supporting documents, details and evidence within four weeks, The court directed the collector to consider the same in accordance with law, including the Land Encroachment Act, 1905, after giving all parties concerned a hearing.
